At the outset, please be advised that the Public Records Act (PRA) does not require public agencies to make disclosable documents available within a certain time frame or by a set date established by the requestor. Rather, Government Code section 6253(c) requires that generally within 10 days from receipt of a request, a public agency make an initial determination of whether it has disclosable documents in its possession responsive to the request.
Additionally, the PRA does not require a public agency to provide information, answer questions, or compile lists in response to a PRA request. A public agency is only required to provide existing records that are currently in its possession, custody, or control, and that are not exempt from disclosure pursuant to the PRA. Accordingly, the following constitutes the District’s determination regarding whether it has disclosable documents in its possession responsive to your request.
